General Terms and Conditions (GTC) for IRIS PHOTO.ART Physical Stores

1. Scope & Contracting Parties
1.1 These General Terms and Conditions (GTC) apply to all purchases made in IRIS PHOTO.ART physical stores (galleries, exhibitions, or partner locations).
1.2 The specific store location and responsible franchise company are stated on the purchase receipt or store signage. Each local franchisee is an independent contractual partner, responsible for sales and order fulfillment at their respective location.

2. Contract Formation & Payment
2.1 Purchase Agreement
A binding purchase contract is concluded when:
✔ The Customer makes a payment at checkout, or
✔ The store representative confirms the purchase and provides a receipt.
2.2 Payment Methods
- Cash
- Debit & credit cards
- Other payment methods as indicated at the store
Prices include all applicable taxes and are displayed at the point of sale.
3. Custom Orders & Right of Withdrawal
3.1 Personalized Products – No Withdrawal Right
All IRIS PHOTO.ART products are custom-made artworks, created individually for each Customer. Therefore, returns and cancellations are not possible once production has started.
✔ Legal Basis: In accordance with national consumer laws (e.g., § 312g (2) No. 1 BGB in Germany, Article L221-28 French Consumer Code, etc.), the right of withdrawal does not apply to custom-made products.
3.2 Exceptions
Returns or cancellations may be possible in cases of:
- Production defects (e.g., printing errors)
- Damage occurring before handover
In such cases, Customers must report issues immediately upon receipt.
4. Product Pickup & Shipping (If Applicable)
4.1 On-Site Pickup
Most IRIS PHOTO.ART orders are completed in-store and handed over immediately.
4.2 Shipping (If Offered by the Store)
If a store offers home delivery, the following conditions apply:
- Shipping costs are displayed at checkout.
- Delivery times depend on the destination.
- The Customer is responsible for providing a correct shipping address.
4.3 Failed Delivery
If delivery fails due to an incorrect address or non-collection, additional shipping fees may apply.
5. Warranty & Liability for Defects
5.1 Defective Products
Customers have statutory rights in case of material defects or production errors.
5.2 Exclusions
Warranty claims do not apply if:
- The damage is caused by improper handling.
- The product has been altered after purchase.
5.3 Reporting Issues
Customers must inspect their order immediately upon receipt and report defects to the store staff.
6. Gift Vouchers & Promotional Offers
6.1 Gift Vouchers
- Valid for 1 year from the date of purchase.
- Can be redeemed at the issuing store only.
- Non-refundable and cannot be exchanged for cash.
6.2 Promotional Discounts
- Store-specific promotions may apply.
- Discounts cannot be combined unless explicitly stated.
7. Data Protection
7.1 Processing of Customer Data
IRIS PHOTO.ART stores process customer data only as necessary for transaction processing.
7.2 Use of Photographic Data
As part of our services, we capture and process images of customers' irises to create artistic photographs. The processing is conducted in accordance with the General Data Protection Regulation (GDPR) and national laws.

8. Disclaimer of Liability
8.1 General Limitations
IRIS PHOTO.ART stores provide artistic iris photography services using safe and non-invasive technology. However, we are not liable for:
✔ Personal dissatisfaction with the artistic outcome
✔ Loss of digital files after purchase
✔ Technical disruptions beyond our control (e.g., force majeure)
8.2 Liability Exceptions
These exclusions do not apply in cases of:
- Intentional misconduct or gross negligence
- Harm to life, body, or health
9. Governing Law & Dispute Resolution
9.1 Applicable Law
Purchases in IRIS PHOTO.ART stores are governed by the laws of the country where the store is located.
9.2 Dispute Resolution
If disputes arise, Customers may:
✔ Contact the local store operator directly.
✔ Seek mediation via national consumer protection authorities.
IRIS PHOTO.ART does not participate in EU online dispute resolution platforms unless legally required.
